Terms of Use

These Terms of Use ("Terms") govern your use of the Calendout mobile game ("the App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. App Purpose

Calendout is an entertainment game that turns built-in fictional events or events from your current iOS calendar week into a Breakout-style game board with bosses, scores, sound, haptics, and achievements.

2. App Store License

The App is licensed, not sold. Your use of the App is also subject to Apple’s Standard Licensed Application End User License Agreement and applicable App Store Usage Rules. If these Terms conflict with mandatory terms imposed by Apple or applicable law, those mandatory terms control.

3. One-Time Purchase

Calendout is offered for a one-time purchase price displayed by the Apple App Store before purchase. The App does not include subscriptions or in-app purchases. Apple processes payments, redownloads, family sharing where available, and refund requests under Apple’s applicable terms and policies. Prices and taxes may vary by country or region.

4. Calendar Permission and Your Content

Calendar access is optional. If granted, calendar data is used locally to create the game board. You are responsible for the calendar information available on your device and for ensuring you are authorized to access it. The App does not claim ownership of your calendar events.

5. Acceptable Use

You may use the App for lawful personal entertainment. You must not misuse the App, interfere with its operation, attempt unauthorized access, use it to violate the rights of others, or copy, modify, distribute, reverse engineer, or create derivative works except where applicable law expressly permits such activity.

6. Intellectual Property

The App, including its code, game mechanics, characters, artwork, audio, interface, text, and branding, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms and Apple’s Standard EULA, you receive a limited, non-exclusive, non-transferable license to use the App on supported Apple devices you own or control.

7. Updates and Compatibility

We may provide updates, balance changes, new bosses, compatibility fixes, or other modifications. Features may change over time. We do not guarantee compatibility with every device, calendar configuration, future operating-system version, or third-party calendar provider.

8. Availability

The App is primarily designed for offline use. Some functions outside the App, including App Store purchase processing, redownloads, system calendar synchronization, email support, and linked web pages, depend on Apple or other third-party services that may be unavailable or changed without our control.

9. Disclaimer

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free operation, preservation of local progress, or that every calendar event will be displayed exactly as it appears in another calendar application.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of local game progress, calendar display differences, profits, data, or goodwill arising from use of or inability to use the App. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.

11. Privacy

Your use of the App is also governed by the Calendout Privacy Policy.

12. Termination

Your right to use the App may terminate if you materially violate these Terms or Apple’s applicable license terms. Provisions that by their nature should survive termination, including intellectual property, disclaimers, and limitations of liability, will continue to apply.

13. Changes to These Terms

We may update these Terms when the App or applicable requirements change. The updated version will be posted on this page with a revised effective date. Continued use of the App after an update means you accept the revised Terms where permitted by law.
