Terms of Use

These Terms of Use ("Terms") govern your use of AquaTale. By downloading or using the app, you agree to these Terms. A parent or legal guardian must review and accept these Terms for a child who uses the app.

1. The AquaTale Experience

AquaTale is a creative entertainment app that lets users draw fish, import or photograph drawings, turn them into animated aquarium characters, and customize an aquarium. Features may change as the app develops.

2. Free App and One-Time PRO Purchase

AquaTale is free to download and includes free functionality. The app may offer an optional, non-consumable one-time purchase that unlocks PRO features identified in the purchase screen. This is not a subscription and does not automatically renew.

The price and currency shown by the App Store at the time of purchase apply. Payment is charged to the Apple Account used for the purchase. Purchase processing, refunds, billing questions, and applicable consumer rights are also subject to Apple’s terms and App Store policies. PRO access may be restored using the same Apple Account where supported by Apple.

3. Family and Child Use

Children should use AquaTale with the knowledge and supervision of a parent or guardian. Adults are responsible for device settings, camera and photo permissions, purchases, sharing, and support communications. Use available iOS purchase controls when a child uses the device.

4. Your Drawings and Images

You retain ownership of drawings, photos, and other content you create or select. You grant the app the limited permission needed to process, display, animate, and store that content on the device to provide AquaTale’s features. You must have the right to use any content you import and must not use unlawful, harmful, or infringing material.

5. Acceptable Use

You may use AquaTale only for lawful personal and family purposes. You must not attempt to reverse engineer the app except where applicable law expressly permits it, interfere with its operation, bypass purchase controls, introduce malicious code, or use the app to violate another person’s rights.

6. Intellectual Property

AquaTale’s software, interface, branding, original artwork, animations, documentation, and other materials are owned by us or our licensors. These Terms give you a limited, personal, non-exclusive, non-transferable right to use the app; they do not transfer ownership of our intellectual property.

7. Availability and Changes

We may update, add, remove, or modify features, visual assets, compatibility, and PRO functionality. We do not guarantee that the app will be uninterrupted, error-free, compatible with every device, or able to recognize every drawing or photograph.

8. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, AquaTale is provided "as is" and "as available" without warranties of uninterrupted or error-free operation. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of drawings, photos, app data, or access arising from use of or inability to use the app. Nothing in these Terms limits rights or liability that cannot legally be limited.

9. Privacy

Your use of AquaTale is also governed by the AquaTale Privacy Policy.

10. Changes to These Terms

We may update these Terms as AquaTale develops. The current version and effective date will be posted on this page. Continued use after an update means acceptance of the revised Terms where permitted by law.
